Payment must be made within the timeframe specified in the invoice or confirmation.

In the event of payment default:

  • A penalty charge of USD 500 shall be applied.
    • In addition, a late payment charge of 5% of the total outstanding amount shall apply for each month the Sponsor remains in default.

These amounts represent agreed compensation for administrative and financial impact resulting from delayed payment and are not intended to operate as a penalty.

If a participant fails to make any payment or otherwise breaches these Terms, and fails to cure such breach within a reasonable time after receiving written notice specifying the breach, Energia shall have the right, without further notice, to exercise one or more of the following remedies:

(i) cancel participation in whole or in part;
(ii) suspend or revoke access credentials;
(iii) evict the Sponsor from any allocated exhibition space;
(iv) specifically enforce any provision of these Terms; and/or
(v) exercise any other remedy available under applicable law.

For purposes of this Section, “reasonable time” means:

  • immediately, in the case of any breach occurring during the Event;
    • twenty-four (24) hours, in the case of any failed payment;
    • five (5) days, in the case of any other breach.

Energia may retain any and all monies received as liquidated damages, it being understood that Energia’s losses and damages resulting from such breach are difficult to ascertain and that such liquidated damages are agreed as a reasonable pre-estimate of loss and are not intended to operate as a penalty.

Sponsors remain liable for the full contracted amount regardless of reallocation of space.
